North Carolina Heroin Laws

Heroin and other highly-addictive narcotic drugs are illegal under both federal and state laws. While many states offer drug diversion programs that offer heroin crime defendants treatment rather than prison, this option is not available in North Carolina. Simple possession of heroin is charged in the state as a Class I felony, carrying anywhere from 3 to 12 months in jail upon conviction.

Penalties may increase if a defendant is accused of selling heroin, especially if it is to a person under 16, a pregnant woman, or within 300 feet of a school. Individuals who are found to be distributing 4 grams or more of heroin may be charged with drug trafficking, increasing these penalties even further. At maximum, if found with more than 28 grams of heroin, a person can face Class C felony charges and up to 279 months in prison and $500,000 in fines.
